Acceptable
Use Policy:
ANewVision's
InterNet Services ("ANewVision") provides uncensored, unmetered
usage to the Internet. Users must not abuse the "unmetered"
aspect of our service. "Unmetered Usage" means that you
will not be charged any hourly fees. Your computer may remain
connected to the Internet via ANewVision's dial-up modems
as long as its keyboard and/or mouse are operated at all
times by a human operator. Unmetered usage does not mean
you may leave your computer continuously connected to the
Internet. Usage in excess of 5 hours per day (150 hours
per month), on a very regular basis is considered abusive
usage of the system and you must upgrade to a dedicated
line or curtail usage. It is an illegal use of the system
to automate any software to enable your connection to remain
active when a human being is not actually using the computer.
You will be temporarily disconnected after 20 minutes of
inactivity. You may not configure your computer so as to
permit any other computer to access your computer while
your computer is connected to ANewVision. You may not resell
or transfer your access to others. Users who attempt to
violate these restrictions will be immediately disconnected
and their account will be terminated, with no refund of
subscription fees.
If
you are currently a member and these terms of Acceptable
Use are not acceptable to you, please notify our office
to terminate your account.
You
must be at least 18 years of age to qualify for membership
in ANewVision. There can be no exceptions to this age requirement.
Service:
ANewVision reserves the right to refuse service to anyone
for any reason and to terminate service to any existing
account at our discretion.
Service
will commence upon the date that your application and payment
for the setup fee and first month's service are received.
This date is the "Commencement Date".
THE
INTERNET ANewVision's InterNet Services SERVICE IS PROVIDED
ON AN "AS-IS, AS AVAILABLE" BASIS. NO WARRANTEES, EXPRESSED
OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT
TO ANewVision's InterNet Services OR ANY INFORMATION OR
SOFTWARE THEREIN. THIS NO WARRANTY EXPRESSLY INCLUDES ANY
REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF
SERVICE BY ANewVision's InterNet Services OR ITS PROVIDERS.
Neither
ANewVision's InterNet Services nor its Information Providers
are responsible for any damages arising from User's use
of ANewVision's InterNet Services or by User's inability
to use ANewVision's InterNet Services service, including,
but not limited to, email, World Wide Web and File Transfer
protocol services.
ANewVision
will make access available to you on a best effort basis.
Service outages can occur over which we have no control.
In the event an outage lasts more than 48 hours, we will
at your request, prorate the applicable portion of your
monthly service charge. This DOES NOT apply to customers
who's computer for what ever can not access the Internet,
due to a problem with their hardware, software or telephone
line.
Software:
As a
courtesy to subscribers, we have accumulated a library of
software, which is "shareware" or "freeware". ANewVision
is not the author of or otherwise responsible for any such
software, nor is ANewVision engaged in the sale or licensing
of such software. The subscriber and any other user assumes
all risk of any kind with respect to such software. The
subscriber is responsible for payment of any licensing fees.
No subscriber or user will assert any claim against ANewVision
with respect to any "shareware" or "freeware" obtained through
ANewVision or otherwise.
Support:
ANewVision's InterNet Services is only responsible for supporting
issues directly related to connecting via modem to our service,
and connecting to the Internet via the software provided
with our sign-up, and only that software. ANewVision's InterNet
Services will not be responsible for modem communications
problems , modem support, modem installation or modem failure.
In addition, ANewVision's InterNet Services will not be
responsible for new software installation, new software
configuration, or new software failure if the software is
not provided and endorsed by ANewVision's InterNet Services.
Unacceptable
behavior:
ANewVision reserves the right to suspend or terminate service
to you if your actions threaten the integrity or continued
operation of our network or in ANewVision's sole discretion,
your actions or behavior on the Internet are deemed unacceptable.
Warranty:
Limitation of Liability ANewVision's services are provided
on an "as is" and "as available" basis with no warranty
of any kind. Under no circumstances is ANewVision to be
held responsible for any indirect, incidental, special or
consequential damages arising from the subscriber's use
of ANewVision's service.
Indemnity:
The
subscriber agrees to indemnify and hold harmless ANewVision,
its directors, officers, shareholders, agents, employees
and its other subscribers from any and all claims, liabilities,
damages or expenses (including attorney fees) arising out
of or resulting from any and all use of the subscriber's
account or the subscriber's Web Site, whether authorized
by ANewVision or the subscriber or not.
Transferability:
The
subscriber's account is not transferable without ANewVision's
consent. The subscriber agrees to keep confidential their
username and password to keep the said account secure from
unauthorized users and use.
Confidentiality:
ANewVision treats E-mail messages as private except as outlined
in the Electronic Communications Privacy Act of 1986 (ECPA).
The ECPA permits ANewVision limited ability to intercept
and/or disclose electronic messages. Subscribers should
be aware that electronic messages may be intercepted lawfully
or unlawfully outside of ANewVision's system. ANewVision
cannot guaranty that its system or a subscriber's stored
data will be free from unauthorized intrusion or otherwise
guaranty the privacy of information for any subscriber.
Payment
for Service:
Payments for service is due by the due date, (which is usually
the 1st.), of each month, paid in advance. On the 5th. Day
of the month, accounts not brought up to date will be disabled
until payment is received. If payment is still NOT PAID
by the last day of the month, the account goes to FULL CANCELLATION,
and you will have too reapply once again. Cancellations
received after the due date will take effect after the last
day of the current accounting cycle.
Delinquent
accounts will be charged 1 1/2 percent per month, and the
customer agrees to pay all collection fees incurred on delinquent
accounts. A $5.00 late fee will be applied to ALL accounts
that their payment does not REACH our office by the fifth
of the month. A $10.00 reconnection fee will be required
with the payment for the current month before the account
is reactivated. All payments are final and no refunds for
unused time will be honored.
NSF
Payment: (Checks / ACH)
Any checks
and/or drafts returned to ANewVision will be charged an
additional $25 & may be subject to suspension of service.
STOP
Payment: (Checks / ACH )
Any checks
and/or drafts returned to ANewVision with a STOP payment
notice will be charged an additional $25 and an immediate
cancellation of their account.
1,
2 & 3 Year Term Customers:
To terminate your contract prior
to term date, you will be backcharged the normal rate of
$17.00 per month times the amount of months of service plus
a $25.00 cancellation fee.
Payment
Guaranteed by Customer:
Check/Cash paying customer MUST either have
an ACH " Auto withdrawal from checking " form
on file or a valid Credit Credit. Customer agrees that if
the payment is not made by the due date, we ANewVision are
hereby granted permission to charge their ACH or Credit
Card for the total amount due..
Cash/Check
Customers
Monthly cash/check customers who are late twice in a 12
month period will be required to pay by the quarter plan
(3 months).Once placed on the the quarter payment plan and
the account becomes late, you will then be placed on the
semiannual plan ( 6 months ). Once again late annual plan
( 12 months ).
Cancellation:
You may cancel your account at anytime,
providing you give us a (5) business day notice prior to
the end of your payment period. You MUST cancel using
our Cancellation Form on our website at http://www.anvis.com/cancel.htm.
Sending Email to us WILL NOT BE ACCEPTABLE....If you do
not give us the mandatory (5) business days, then you will
be responsible for the full amount of your next payment
period. You MUST Delete the
ANewVision Dial Up Icon from your PC, if you log onto our
network after your Cancellation Date, YOU will
be charged for that month in FULL.
Scenario:
If you cancel your phone for the end of the month
& it takes till the 10th. Does this give you the right
from the 1st till the 10th. to use the service & make
long distance calls for FREE? I THINK NOT. If you USE our service, then you will PAY for our service.
Refund
of Payment:
A refund ( In Store Credit ONLY
) for services not rendered may be given to the
customer only when the customer has paid for more than one
month in advance. If customer has been given a discounted
rate for paying for services in advance, then chooses to
cancel, the amount of refund will be determined by first
reverting to the NORMAL RATE.
THE
AMOUNT OF IN STORE CREDIT IS DETERMINED BY
ANEWVISION INTERNET SERVICES.
Our Determination is Final
By
accepting membership, you are consenting to be bound by
the above agreement and you avow that you are at least 18
years of age. Usage or continued usage of your account rights
also constitutes acceptance of the Terms and Conditions
stated above.
If
you are currently a Member of ANewVision and choose not
to accept and abide by the above Terms and Conditions, please
notify us at once to terminate your account.
IT
IS THE USERS RESPONSIBILITY TO CHECK THE DIAL UP ACCESS
NUMBER TO BE A TOLL CALL OR NOT
CHECK

ANewVision
reserves the right to update and/or modify this agreement
at any time, without prior notice.
